2. Privacy and Confidentiality: Participants' personal information should be protected and only shared with consent.
3. Quality of Service: Participants have the right to receive high-quality services that are safe, respectful, and tailored to their needs and goals.
4. Complaints and Feedback: Participants can provide feedback or lodge complaints if they are unhappy with the services they receive.
5. Service Agreement Termination: Participants can terminate the service agreement with their provider if they believe their needs are not being met. Adequate notice should be given as per the terms of the agreement.
Responsibilities:
1. Communication: Participants should clearly communicate their needs and goals to their providers.
2. Respect and Safety: Respect the rights and privacy of service providers.
3. Payment and Notice: Ensure timely payment for services received and provide notice if plans or schedules change.
For Providers:
Rights:
1. Fair Treatment: Providers have the right to expect respect, safety, and fairness from NDIS participants and their families.
2. Service Agreement: Providers can set terms and conditions, including how and when services can be withdrawn or terminated.
Responsibilities:
1. Person-Centered Approach: Providers must deliver services that respect the participant’s dignity, personal goals, and preferences.
2. Transparency: Clearly outline services, costs, expectations, and processes for service withdrawal in the service agreement.
3. Compliance: Follow all NDIS Practice Standards and regulatory requirements.
4. Safe and Quality Services: Ensure services are delivered safely, healthily, and respectfully.
Withdrawing Support:
1. Participants Withdrawing Support:
- Must refer to the service agreement for terms related to notice period and any specific procedures. Typically, a notice period is mentioned in the agreement.
- Communicate the decision in writing to the provider, citing the desire to withdraw from the service.
2. Providers Withdrawing Support:
- Providers should follow the notice period outlined in the service agreement.
- Supply written notice explaining the reasons and ensure a smooth transition for the participant to find alternative supports.
- Consider potential consequences and prioritise participant well-being during the transition.
Knowing your rights and responsibilities under the NDIS ensures smoother interactions and clarity for all parties involved.
